What does Linktree do?

Linktree is your launchpad to share your latest video, article, recipe, tour, store, website, social post, and other content. Our platform helps you connect with and message your audience, making your content more discoverable, easier to manage, and capable of driving revenue. Linktree also enables you to connect with brands and social commerce opportunities, allowing creators to monetise their content by driving traffic to various revenue-generating channels.

This Privacy Notice applies to our websites and services which include Linktree (https://linktr.ee/), tr.ee (https://tr.ee/links), Linktree for Business (https://business.linktr.ee/), Plann (https://www.plannthat.com/) and their mobile app, developer portal and related software or features (collectively referred to as our “Platform” or “Linktree”). The Platform allows individuals and businesses to sign-up to create personalised, easily-customisable pages, monetise their content, participate in commerce opportunities, schedule social media content and/or subscribe to, follow, purchase from, or message other Linktree Users. It also supports individuals who interact with the Platform directly or through third party applications that connect with Linktree, businesses that interact with the Linktree Users through Linktree for Business, and developers who create functionality that interacts with the Platform.

In this Privacy Notice, we collectively refer to the Platform and our related services as the “Linktree Services.” The pages that Linktree Users are able to create using the Linktree Services are referred to as “User Profiles.” User Profiles—including any information or content displayed on them—are public by default and discoverable and visible by anyone. Users may elect to restrict access to their profile by enabling password protection, which limits access to individuals who possess the required password.

We are headquartered in Melbourne, Australia. For more information about Linktree, please see the “About” section of our Website at https://linktr.ee/about/.

How does this Privacy Notice apply to me?

This Privacy Notice only applies to personal information we collect as a controller about:

• individuals who visit, sign up to use, or interact with the Linktree Services or User Profiles, whether directly or through third party applications that connect with Linktree;
• individuals that sign up to use our Linktree Services via a free or paid plan;
• individuals who follow, subscribe to, purchase from, and/or message other Linktree Users;
• developers that sign up to our developer portal in order to build functionality that interacts with the Linktree Services; and
• individuals who respond to our surveys, marketing materials or participate in trade promotions or competitions that we may run from time to time.

In this Privacy Notice, we refer to all of the above individuals collectively as “Linktree Users.”

This Privacy Notice applies to the processing of personal information by Linktree as a controller. When we talk about Linktree acting as a “controller,” we mean that Linktree determines the purpose and the means of the processing (i.e. we make decisions about why and how we handle your personal information). Because of the nature of our services, we may also act as a “processor” on behalf of a Linktree User. In these instances, we facilitate the processing of personal information on behalf of the Linktree User and based on their instructions. For example, if you share your information with a Linktree User or make a payment to them, we facilitate this processing (“Processor Services”). This Privacy Notice does not address our Processor Services. If you subscribe to or otherwise share your information with a Linktree User, and want to know how they handle your personal information, please get in touch with that Linktree User directly and/or refer to any privacy notice they have posted on their User Profile.

If you provide us with information about another person (if, for example, you are a representative of an individual), you must provide them with a copy of this Privacy Notice and let that other person know that we use their personal information in the ways set out in this Privacy Notice.

Third-party processing and responsibilities

Linktree enables connections between Linktree Users and third parties, such as brands, advertisers, social platforms, AI-providers, and affiliate partners. Once you interact with a third party—such as by adding Linktree as an integration, clicking a link, subscribing to a brand’s updates, or making a purchase through a third-party link—Linktree does not control how your personal information is processed by that third party.

We strongly recommend reviewing the privacy policies of any third parties you interact with via Linktree. If you have concerns about how a third party handles your personal information, please contact that third party directly.

Information we collect

The personal information that we may collect about you broadly falls into the following categories:

1. Information you provide voluntarily
   When you use and/or engage with the Linktree Services, you may choose to provide personal information voluntarily.

   ‍Account and Profile Information: When you create a Linktree account, we will ask you to provide some information which may include your email address, password, name, username, date of birth or age, profile picture, biography, social media handles, and other profile information. The type of information we ask you to provide depends on the features you use.

   ‍Payment and Transaction Information: If you use a paid plan or engage with one of our commerce products, we will ask for additional information, such as your full name, billing email address, billing address and payment method. We will also collect information about your purchase history and transaction records. We collect this information in order to facilitate billing, to make commission payments to you, and to enable you to view your transaction history information so you can track and manage your purchases made via other Linktree Users. We may also use this information to make better recommendations.

   ‍Communication Data: Our platform includes communication features such as messaging. If you use these features to message other Linktree Users, we process the text and other content you send directly to other Linktree Users to provide and maintain the messaging functionality and for other legitimate business interests. If you subscribe to a Linktree User or message them outside of the Platform, we may collect information such as your name and email address and communication preferences to facilitate those interactions. You may also provide personal information when contacting us directly, for example, if you submit queries or submit violation reports (such as an Intellectual Property Report or Counter Notice). In such cases, we typically ask you to provide your name and email address so that we can respond to your queries and, if you are making an Intellectual Property Report or Counter Notice, we also ask you to provide your address, phone number and details regarding the intellectual property rights concerned.

   ‍Search Data: We collect information about searches you perform on the Linktree Services, such as looking up other Linktree Users or querying information about them. This includes searches made directly through the Platform or via third party applications and services that integrate with Linktree, like when using the Linktree app within ChatGPT. This data is used to deliver relevant results, maintain and improve the Linktree Services (including by making User Profiles more discoverable), and ensure platform integrity. We may also review search activity to enforce our Terms of Service and Community Standards.

   ‍Shared Interaction Data: In some situations, a Linktree User might request that you provide information to them through the Platform, which may include your email address, mobile number, date of birth, age, or other personal information, in order to share updates, join their community, or gain access elements of their User Profile (such as locked content). Similarly, if you choose to connect with a brand on Linktree, you may provide additional personal information voluntarily when communicating with the brand in-platform.

   ‍Survey and Promotions Data: You may also provide personal information voluntarily if you respond to our surveys, marketing materials, or through your participation in trade promotions and competitions we may run from time to time. This may include, for example, your name, contact details, demographic information, preferences, or responses to specific questions, depending on the nature of the survey or promotion.

   Age Assurance Information: In certain circumstances, we may require you to verify your age in order to access specific features, content, or monetisation tools on the Platform, or to comply with legal requirements.

   Where age verification is required, you may be offered different methods to confirm your age. One available method may involve the analysis of a selfie image or live camera capture by our age assurance provider, Yoti.

   If you choose this method, your image will be processed by Yoti solely for the purpose of estimating your age. The biometric data generated during this process is not shared with Linktree and is deleted by Yoti shortly after the age estimation is completed in accordance with our contractual arrangements with them. Linktree does not store or retain biometric templates or facial recognition data. You can find further information about Yoti in their privacy notice.
2. Information that we collect automatically
   When you use the Linktree Services, we collect certain information automatically from you.

   Usage and Analytics Data: We collect information like your IP address, device type, unique device identification numbers, browser-type, broad geographic location (e.g. country or city-level location), time zone, usage data, diagnostic data and other technical information. We may also collect information about how you arrive at Linktree Services, including the referring website or service, and how you interact with the Linktree Services and User Profiles, including the pages accessed and links clicked. Collecting this information enables us to better understand you, where you come from, and what content interests you. It also allows us to make tailored recommendations, share useful analytics with Linktree Users, and provide insights to our business partners. Some of this information may be collected using cookies and similar tracking technology, as explained further under the heading “How do we use cookies and similar tracking technology” below.

   Email and Communications Engagement Data:

   Where we send you emails or other communications (such as marketing messages, product updates, or service-related notifications), we may collect information about your interaction with those messages, such as whether you open them or click on links within them. This helps us understand engagement, improve our communications, and measure the effectiveness of our messaging.

   ‍Content Moderation Data: We may undertake automatic scanning of your content—including User Profiles, links, communications (such as messages), and searches you perform—to support compliance with our Terms of Service and Community Standards. This helps us determine whether mandatory or default sensitive content warnings should be applied and presented to people who wish to access the relevant User Profile or linked content, whether any content should be removed from the Linktree Services, or whether any User Profiles should be suspended in line with our Community Standards or Terms of Service, while also informing suitability for certain features, including monetisation opportunities such as affiliate marketing and sponsorships. When a Linktree User changes their User Profile, we may also notify relevant subscribers to that User Profile that updates have been made. We may also restrict access to, or block the display of, certain content in jurisdictions where it is prohibited or not permitted under applicable laws or regulations.
3. Information that we obtain from third party sources
   We may receive personal information about you from third party sources to help us deliver and improve the Linktree Services. Those sources include external websites and social platforms that you choose to provide to us or connect to your Linktree account, service providers that assist with marketing campaigns or competitions, and our partners who help us provide our Linktree Services.

   Social Content and Data: If you connect your Linktree account to a third-party social platform—such as Instagram, TikTok, or YouTube—or you provide a link to an external website or online profile during account creation, we collect and process information from those accounts and websites. This includes publicly available content and associated data like basic account information, follower or subscriber information, social media posts, reels, photographs, videos, livestreams, audio recordings, engagement metrics, audience demographics, comments and messages, and other content and metadata made available through the link or connection. We use this information to help you manage your social presence through the Linktree Services, including to generate a suggested profile for your account, display your social content through your User Profile, provide AI-powered insights, personalize your experience and make recommendations, and for other purposes described in this Privacy Notice. If you connect your account to YouTube, Linktree uses YouTube API Services to access and display your YouTube channel and video data (such as basic account information, subscriber and follower counts, videos, and engagement metrics) within the Linktree Services. By connecting your your account to YouTube, Linktree may also update certain content on your YouTube account at your direction, such as editing video descriptions, to help you manage your links across platforms; you may also delete any stored data or revoke Linktree’s access to your YouTube data at any time through Google’s Security Settings. Google’s privacy policy can be viewed here.

   Social content you choose to display on your User Profile through connected accounts may include sensitive information, such as information about your religious or political views, sexual orientation, health, philosophical beliefs, or racial or ethnic origin. Linktree does not require you to provide this type of information, and you decide what content to display. If you choose to share any such information through the Linktree Services, please be aware that it will be publicly visible through your User Profile.

   Affiliate and Commerce Data: Social media networks may provide your profile picture and follower information to help us to connect Linktree Users (including you) with brands, retailers and affiliate networks (“Affiliate Partners”) as part of the Linktree Services. Similarly, Affiliate Partners may provide information on completed transactions that originate from a link on a User Profile to track and process commission payments. We may also receive information from our payment processors to support commerce products, enabling us to calculate commission payments and provide services to Linktree Users such as transaction dashboards. In all cases, we ensure that these third parties have your consent or are otherwise legally allowed or required to share your personal information with us.

   Third party integrations: If you access or use the Linktree Services through a third party application or service—for example, if you use the Linktree app within ChatGPT—we collect information from that service or that you provide through it in order to provide the Linktree Services. This may include information needed to create and manage your Linktree account, such as your username, email address, and profile details, and other information described in this Privacy Notice. Similarly, if you choose to authorize or enable third party services, applications or tools to connect or interact with the Linktree Services on your behalf, such as Claude, ChatGPT, Cursor, or any other third party tool, we collect information from that platform in order to perform the actions you authorize on your Linktree. We retrieve data on demand from these platforms in response to specific queries you may input.

   Any information collected by us through third party integrations is processed as described in this Privacy Notice.
   ‍
4. ‍Information that we collect in connection with recruitment activities
   If you apply for a role at Linktree, we will collect, use and access your personal information for recruitment purposes. This may include your name, contact information, resume, references, and any other details you choose to submit. If your application is unsuccessful, we may retain your information on file for a maximum of two years for consideration in future opportunities. You can request to opt out of this retention at any time. After two years, your information will be anonymised for statistical purposes. Linktree currently uses Gem Software, Inc. (“Gem”) to collect, store and process data for recruitment purposes. We only engage third party service providers after careful and comprehensive review of the service provider’s technical and organisational data protection measures. You can find further information about Gem’s privacy policy.

How we use the information we collect

We will use the information we collect for the purposes described in this Privacy Notice or for other purposes that we explain to you at the time we collect your personal information.

In some countries, including countries in the European Economic Area and the UK, we are required to have a legal basis to process your personal information. These legal bases include, first, the performance of a contract—this applies when we need to process your information to provide you with the Linktree Services under our Terms of Service, or to take steps before entering into a contract with you. We may also rely on our legitimate interests, where processing your information is necessary for our business and those interests are not overridden by your rights. In some cases, we process your information based on your consent—this means we’ll ask for your permission before using your information for certain purposes. Finally, we may need to process your information to comply with legal obligations, such as responding to lawful requests.

The table below provides a summary of the purposes for which we process your personal information, the legal basis we rely on in each case, and the categories of information involved. This is intended to give you a clear overview of how and why we process your information.

‍

Children’s data

Certain features and services are intended for users who are 18 years of age or older. Where Linktree expressly permits access by users under 18, we handle their personal information as described in this Privacy Notice and may apply additional age requirements, protections, restrictions, or eligibility checks as required by applicable law. These may include limiting access to certain features, applying age-based protections, restrictions, or feature limitations based on information available to us, the features or services you want to use, and applicable law. If you are a parent or guardian and you are aware that an individual (of whom you are a parent or guardian) has provided us with personal information in violation of applicable age requirements, please contact us. We will, upon notice or discovery, take reasonable steps to address the issue, including deleting personal information where required by applicable law.

How and when we share the information we collect

Your information may be shared with others in the following ways:

Publicly available information

The Linktree Services are designed to make Linktree Users more discoverable to others. User Profiles and the content displayed on them are publicly accessible to anyone by default, unless you choose to restrict access by enabling password protection. Where password protection is enabled, your User Profile will only be accessible to individuals who have the password. This means that, unless restricted, your User Profile may appear in search results provided by internet search engines (like Google) or in responses generated by chatbots (like ChatGPT or Claude). If you choose to connect your Linktree account to third-party platforms—such as Instagram, TikTok, or YouTube—additional information, including your linked social content, engagement metrics, and related insights, will also become publicly visible through the Linktree Services and external search engines and platforms.

By creating a User Profile using the Linktree Services, you are directing us to share this information publicly. You should only include information on your User Profile that you are comfortable sharing publicly.

Information shared with other Linktree Users

If you send messages to other Linktree Users through the Platform, you authorize us to share the content of those messages and your contact information with that User. We will also share your information with other Linktree Users if you subscribe to or sign up to be part of their community, or download or purchase content from them. If you engage with a Linktree User in these ways, they receive information about you to help them better understand and serve their community, including information needed to add you to their community outside of the Platform where applicable, and information needed to be able to provide the paid content.

Information shared with third parties

We may disclose your personal information to the following categories of recipients:

• to our group companies and third party services providers that support the delivery of the Linktree Services to you, including services for delivering and improving the functionality of the Linktree Services, analysing how the Linktree Services are used, cloud hosting and infrastructure, data storage and analytics, customer support and communications, payment processing and billing, marketing and advertising, security and fraud prevention,  platform integrity services and age assurance services.  A list of our current group companies is available here . We also facilitate payments through our third party payment providers, as set out in more detail below;

This may include location data, conversion metrics, engagement rates, messaging response rates, and other activity data and analytics.
• with third party applications and services that integrate with Linktree. Certain integrations or data-sharing features may not be available in all regions, including for Users or User Profiles located in the European Union;

Depending on how you use the Linktree Services and your geographic location, we may disclose your personal information to third parties whose products are advertised on our Platform or who wish to engage in advertising on our Platform. This may include sharing information with advertising networks and marketing service providers to display advertisements on Linktree and across non-affiliated websites, applications, and online services. These third parties may use cookies, pixels, and similar technologies to collect information such as device identifiers, IP address, and usage data in order to personalize advertising, measure its effectiveness, and improve our promotional efforts. You can manage your advertising preferences or opt out of personalized advertising through your cookie preferences or available tools such as the Google Ads settings.

If you connect your Linktree account to an AI-powered application or agent (such as ChatGPT or Claude), that application may perform actions on your behalf within the scope of the permissions you authorize. Depending on the features you enable, this may include creating, updating, deleting or reorganizing links, modifying your profile or appearance settings, updating social integrations, retrieving analytics, or managing multiple profiles associated with your account or workspace. You are responsible for reviewing and approving the instructions you provide to connected AI applications.

Payment providers

In order to facilitate paid products and/or services within the Linktree Services, and to provide Linktree Wallet services to you, we use third party payment service providers (“Payment Providers”). Commission transaction data from Affiliate Partners is processed internally to manage and display earnings in your Linktree Wallet and facilitate payments. We reconcile transactions internally and send aggregate balances to our Payment Providers, who manage transfers to your connected account.

We do not store or collect your payment card or bank account details; this information is provided directly to our Payment Providers, whose use of your personal information is governed by their privacy policies and their terms and conditions in their role as data controller for these processing activities. Our Payment Providers adhere to standards set by payment card industry data security standards (“PCI-DSS”) as managed by the Payment Card Industry Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information. The Payment Providers we currently work with are:

• Stripe (their privacy policy can be viewed at https://stripe.com/us/privacy);
• PayPal (their privacy policy can be viewed at https://www.paypal.com/webapps/mpp/ua/privacy-full); and
• Square (their privacy policy can be viewed at https://squareup.com/au/en/legal/general/privacy).

Disclosure of personal information to other countries

Your personal information may be transferred to and processed in countries other than the country in which you are a resident. These countries may have data protection laws that differ from, and in some cases may be less protective than, the laws of your country.

Specifically, Linktree may transfer personal information to Australia (where our headquarters are based), the United States and other countries where we conduct business. We may also subcontract certain activities and share your personal information with third parties located in other countries. The countries where these organisations are located will vary, but we generally disclose personal information to organisations located in Australia or the United States. These transfers are necessary to provide the Linktree Services and carry out the activities described in this Privacy Notice.

We have taken appropriate safeguards to ensure that your personal information remains protected in accordance with this Privacy Notice and applicable data protection laws. These safeguards include entering into data transfer agreements between our group companies. Similar safeguards have been implemented with our third-party service providers and partners, and further details can be provided upon request.

We will not transfer your personal information to another country unless we believe there to be adequate safeguards in place. This includes, where applicable, utilising standard contractual clauses approved by the European Commission and by other relevant authorities, or relying on determinations from the European Commission and other relevant authorities about whether countries have adequate levels of protection. We also implement measures to ensure the security of your personal information wherever it is transferred. For more details, please see the “How do we secure your personal information” section below.

How do we use cookies and similar tracking technology?

How long do we retain your personal information?

We will retain your personal information for the period necessary to fulfill the purposes outlined in this Privacy Notice and in accordance with applicable legal and regulatory requirements in respect of permitted or required retention periods and limitation periods relevant to legal action.

How do we secure your personal information?

We have implemented technical, administrative, and physical safeguards to ensure the security of your personal information. These controls include industry-standard encryption, firewalls, intrusion detection, logging, monitoring and regular audits.

In the unlikely event of a data breach, we have a robust incident response plan to mitigate harm and notify affected individuals where we are legally required to do so.

What are your rights and choices?

Linktree Privacy Controls

Linktree provides you with a number of choices about how your personal information is used and shared.

• Account deletion: You may permanently delete your Linktree account and any User Profiles associated with it through your account settings. Deleting your account will remove your profile information from the Linktree Services, subject to limited retention as described in this Privacy Notice.

• Data sharing: You may choose to stop sharing your information with third parties through your account settings. This will disable any further data sharing with Linktree’s business partners and third party integrations (such as integrations that provide access to the Linktree Services through other applications, like ChatGPT, Claude, Cursor, or other connector/integration compatible tools). Please note that disabling data sharing may affect your access to certain monetisation opportunities and reduce the discoverability of your User Profile on third party applications or services. Stopping data sharing will not affect any information already shared with third parties or limit how those third parties use such information in accordance with their own policies. Once information has been shared with a third-party AI provider or application at your direction, that provider may retrain and process the information in accordance with its own terms and privacy policies, even after you disconnect the integration from Linktree.

• Marketing communications: You may opt out of receiving marketing communications from Linktree at any time by using the unsubscribe link in our emails. Even if you opt out of marketing messages, we may still send you service or transactional communications.

• Cookie preferences: You can manage your cookie preferences and opt out of certain cookies or personalized advertising through your browser settings or our cookie management tools. For more information about how we use cookies and how to control them, please see our Cookie Notice.

Rights in relation to your personal information

Depending on where you live, you may have certain rights under applicable data protection and privacy laws in relation to your personal information. You can use our Data Request Form to:

• Access, correct, update or request deletion of your personal information.
• Object to or restrict how we process your personal information.
• Request portability of your personal information.
• Opt out of receiving marketing communications. You can also exercise this right by clicking on the unsubscribe or opt-out link in the marketing materials we send you.

If you have given consent to the processing of your personal information, you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect the processing of your personal information conducted in reliance on other lawful grounds. Depending on the country which you live in and the laws that apply to you, you may also have additional data protection and privacy rights. If you are located in the UK or the European Economic Area, you also have the right to complain to a data protection authority (contact details for data protection authorities in the European Economic Area, UK, and Switzerland are available here, here, and here).

For U.S. residents, please see the section “Your U.S. State Privacy Rights and Additional Disclosures” below for additional information.

We respond to all requests we receive from individuals wishing to exercise their data protection rights in accordance with applicable data protection and privacy laws. In some instances, we may need to verify your identity before granting you access to your personal information or complying with your request.

Note that if you have integrated your Linktree account to a third-party platform, such as an AI service provider, Linktree can only fulfill data subject requests with respect to the personal information Linktree holds about you. To exercise your privacy rights over data held by a third-party platform, you will need to visit the respective platform’s privacy policy.

Your U.S. State Privacy Rights and Additional Disclosures

Depending on the U.S. state in which you reside, you may have certain privacy rights regarding your personal information. If you are a California resident, please see the “Supplemental Information for California Residents” section below. For other state residents, your privacy rights may include (if applicable):

• The right to confirm whether or not we are processing your personal information and to access such personal information and the categories of personal information we are processing or have processed about you;
• The right to obtain a copy of your personal information in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the information to another controller without hindrance, where the processing is carried out by automated means;
• The right, at our option, to obtain a list of the categories or specific third parties to which we have disclosed your personal information;
• The right to delete your personal information, subject to certain exceptions;
• The right to correct inaccurate personal information that we maintain about you, subject to certain exceptions;
• The right, if applicable, to opt out of the processing of your personal information for purposes of (1) targeted advertising; (2) the “sale” of your personal information (as that term is defined by applicable law); and (3) profiling in furtherance of decisions that produce legal or similarly significant effects concerning you;
• If we are required by applicable law to obtain your consent to process sensitive personal information, the right to withdraw your consent; and
• The right not to receive discriminatory treatment by us for the exercise of your privacy rights.

We use cookies and other tracking technologies to display advertisements to you on Linktree and on non-affiliated websites, applications, and online services. This may be considered “targeted advertising” under applicable privacy laws. When we engage in those activities, we sell personal information (i.e., information from cookies) to third-party advertisers and analytics companies. In addition, depending on how you use the Linktree Services, we may disclose your personal information (i.e., customer account and commercial information) to third parties whose products are advertised on our Platform or who wish to engage in advertising on our Platform.

To exercise your rights, please submit a request through our Data Request Form. If legally required, we will comply with your request upon verification of your identity and, to the extent applicable, the identity of the individual on whose behalf you are making such request. To do so, we will ask you to verify data points based on information we have in our records. If you are submitting an opt-out request on behalf of another individual, please use the same contact methods described above. We will process requests from authorized agents in accordance with applicable law. If we refuse to take action regarding your request, you may appeal our decision by replying to the email you received from us in response to your request.

If you would like to opt out of targeted advertising, you may also alter your cookie preferences. For further information about how you can control cookies, please see our Cookie Notice.

Supplemental Information for California Residents

The California Consumer Privacy Act, as amended by the California Privacy Rights Act of 2020 (“CCPA”), requires that we provide California residents with a privacy policy that contains a comprehensive description of our online and offline practices regarding the collection, use, disclosure, sale, sharing, and retention of personal information and of the rights of California residents regarding their personal information. This section of the Privacy Policy is intended solely for, and is applicable only as to, California residents. If you are not a California resident, this section does not apply to you and you should not rely on it.

6. Opt Out Preference Signal

The Website recognizes the Global Privacy Control (“GPC”) signal.
