What an AI copyright lawsuit looks like

Most AI lawsuits are copyright lawsuits. The typical complaint pleads four overlapping theories:

  • Direct infringement on training — the model ingested copyrighted works without a license. This is the question the docket is built around.
  • Output-level infringement — the model emitted near-verbatim reproductions of plaintiffs' works in response to user prompts. The New York Times complaint exhibits remain the canonical demonstration.
  • DMCA § 1202(b) — copyright management information (author names, license terms, watermarks) was stripped during ingestion. Now standard in author and publisher complaints.
  • Contributory and vicarious infringement — typically pleaded against the cloud provider, the model distributor, or downstream deployers who exposed infringing capability to end users.

Fair use is the universal affirmative defense. Whether it succeeds is the question every ruling on this docket is now interpreting.

The four doctrines anyone tracking AI copyright should follow

Fair use on training

Whether ingesting copyrighted works to train a model is transformative fair use. Bartz and Thomson Reuters point in different directions — courts are now drawing the line by source legitimacy and downstream market substitution.

Output memorization

Whether near-verbatim reproductions in model output trigger direct liability. NYT exhibits, GEMA's nine-lyric finding, and Concord's pleadings define the doctrine on this side of the Atlantic.

DMCA § 1202(b)

Whether stripping copyright management information during training-data ingestion gives plaintiffs a separate statutory hook. The count has survived several motions to dismiss, but on September 16, 2026 the Ninth Circuit affirmed dismissal of the § 1202(b) claim in Doe v. GitHub, reasoning that an AI system producing new code without copyright notices does not remove or alter anything.

Source legitimacy

Whether the model trained on legitimately acquired works or shadow-library copies. Bartz made this dispositive, and post-Bartz complaints now plead source provenance specifically.

AI copyright lawsuits: common questions

What is an AI copyright lawsuit?

An AI copyright lawsuit is litigation alleging that an artificial-intelligence system infringed copyrighted works — most commonly through unauthorized reproduction of training data, but also through DMCA § 1202 metadata stripping, output-level infringement (memorized regurgitation), and contributory or vicarious infringement theories tied to model deployment.

How many AI copyright lawsuits have been filed?

AI Lawsuit Tracker indexes 144 AI copyright lawsuits, 58% of the 248 AI cases we track; 113 are still active or pending. OpenAI is named in 34 of the 144 copyright cases we track, more than any other company, followed by Meta (14), Microsoft (14) and Anthropic (13).

What is the fair-use defense in AI copyright cases?

Fair use is the principal affirmative defense. The doctrine weighs four statutory factors — purpose and character of the use, nature of the copyrighted work, amount used, and market effect. Two early rulings have already split it: Bartz v. Anthropic treated training on legitimately acquired books as transformative fair use but pirated copies as infringement, while Thomson Reuters v. Ross Intelligence rejected fair use where the AI competed with the source product. The ~$1.5B Bartz settlement won final approval on July 20, 2026.

What is DMCA § 1202 and why does it matter for AI?

DMCA § 1202(b) prohibits the intentional removal or alteration of copyright management information — author names, license terms, watermarks. Plaintiffs in AI copyright cases routinely add a § 1202 count alleging that training pipelines stripped this metadata during ingestion. The theory has survived motions to dismiss in several actions and is standard pleading in author and publisher complaints, but on September 16, 2026 the Ninth Circuit affirmed dismissal of the § 1202(b) claim in Doe v. GitHub, reasoning that an AI system producing new code without copyright notices does not remove or alter anything.

Has any AI copyright case actually been won?

Partially. Thomson Reuters v. Ross Intelligence (D. Del., Feb 2025) was the first U.S. ruling to reject fair use for AI training that directly competes with the source product — the Third Circuit affirmed it on September 29, 2026. GEMA v. OpenAI (LG München I, Nov 11, 2025) ruled largely for GEMA on lyric memorization. Bartz v. Anthropic produced a bifurcated June 2025 ruling that led to a ~$1.5B class settlement, granted final approval on July 20, 2026.

Are AI copyright lawsuits only about training data?

No. While ingestion of copyrighted training data is the dominant theory, modern AI copyright complaints also plead output-level infringement (the model emitted near-verbatim reproductions), DMCA § 1202(b) metadata stripping, and contributory and vicarious infringement against cloud providers, model distributors, and downstream deployers.

How is the AI copyright docket tracked here?

Case data comes from public dockets, court websites, and primary court records. Non-US cases come from the equivalent foreign court registry. Every entry links back to the underlying docket and is reverified weekly; the lastmod is exposed in the public sitemap.
